The Council on Environmental Quality (CEQ) Adopts Interim Rule to Rescind its NEPA Implementing Regulations from the Code of Federal Regulations

Last week (January 8, 2026), the Council on Environmental Quality (CEQ) adopted its interim rule to rescind its NEPA implementing regulations from the Code of Federal Regulations. This final rule addressed public comments received during the 30-day public comment period and adopts the interim final rule, published in February 2025, without changes. As a result of this change, CEQ no longer has a uniform set of NEPA procedures that all agencies must follow and each federal agency must amend their existing NEPA implementing procedures or establish new procedures if none are in place.
