Update to the Regulations Implementing the Procedural Provisions of the National Environmental Policy Act

On July 15, 2020, the Council on Environmental Quality (CEQ) announced its final rule to update the regulations for the implementation of the National Environmental Policy Act (NEPA). The new regulations will be effective on September 14, 2020.

The Clark Group’s top NEPA experts have been actively following the regulations update since the advance notice of proposed rulemaking was issued on June 20, 2018. Our NEPA experts are now reviewing the final rule for changes to NEPA implementation and the associated implications for our clients, in addition to analyzing the broader implications for stakeholders and the potential environmental, social, and economic impacts.

The final rule requires federal agencies to update their agency-specific NEPA implementing procedures by September 14, 2021 for consistency with the new CEQ regulations.
